RECOMMENDATION

 

a.  Accept Waterline Easement from Hale Industries, Inc. in association with the Quick Quack development at 518 North 400 West.

 

b.  Approve Amendment No. 1 to Revocable Encroachment License and Maintenance Agreement regarding access off of 170 West - Bleaks and Goodfellow-Tullius Trust.

 

c.  Approve Local Public Safety and Firefighter Surviving Spouse Trust Fund Cost-Sharing Agreement between Centerville City and the Utah Department of Public Safety.

 

d.  Approve start of warranty period for C. Johnson Amended Subdivision.

 

e.  Authorize Mayor to sign CLG grant contract, thereby committing a local match of up to $10,000.


BACKGROUND

a.  An additional waterline connection is needed for the Quick Quack development located at 518 North 400 West.  The attached easement is being dedicated by Hale Industries, Inc. for this purpose.  Staff recommends acceptance of this easement.

 

b.  The City previously approved a Revocable Encroachment License and Maintenance Agreement with the Bleaks and Goodfellow-Tullius Trust providing limited access to the back portion of their properties from the stub end of 170 West.  The Property Owners have requested an amendment to the Revocable Encroachment License to eliminate the proposed 16' x 25' concrete approach and to allow them to use an all-weather gravel driveway for the access road to the back portion of their properties.  Staff has visited the site to see the current gravel drive improvements and are supportive of the proposed amendments to the Revocable Encroachment License.  As drafted, the City has the right to require a 4' concrete drive approach in the future if issues arise with tracking mud or other compromises to the public infrastructure.  Staff recommends approval of the proposed Amendment to the Revocable Encroachment License.

 

c.  The City has previously entered into a Cost-Sharing Agreement with the Utah Department of Public Safety regarding the Local Public Safety and Firefighter Surviving Spouse Trust Fund (dated May 1, 2017).  The Department of Public Safety has requested all agencies to enter into a new and updated Cost-Sharing Agreement including two beneficial changes to local agencies.  The new agreement has two new changes:  (1) allows reimbursement from the Fund after 12 months instead of 24 months of insurance payments; and (2) allows reimbursement for health insurance for a line of duty death that occurred after July 1, 2005 instead of July 1, 2015.  Staff recommends approval of the updated Cost-Sharing Agreement.

 

d.  The City Engineer recommends (see attachment) the start of warranty period for the C. Johnson Amended Subdivision, a single-family residential development immediately east of the Episcopal Church.  A remaining bond amount of $27,603 will be held during the warranty period, which includes $2580 for a slurry seal to be applied to the asphalt street. 

 

e.  The Utah Division of State History has awarded Centerville City a $10,000 CLG (Certified Local Government) grant which requires an equal match of local funds, for a total project value of $20,000.  The project includes $15,000 for restoration of windows, doors, masonry, windows, etc. on the Whitaker Home Museum building, and $5000 for the Landmarks Commission, to be used for training, Intensive Level Survey and National Register Nomination.  The local match has not yet been budgeted, but the City Manager assumes the Council will approve such match in the FY 2019 Budget to be adopted in June.  The City Manager's Proposed Budget assumes the General Fund will provide a match of $2500 for the Landmarks portion and that the Museum's match of $7500 will come from the Museum's normal RAP Tax allocation.  

 

In addition to signing the attached grant contract, the Mayor would sign the attached "Preservation & Maintenance Agreement" in which he commits the City to preserve and maintain the building's historical integrity for at least five years as one of the conditions of accepting this grant.
